Estos Términos de Servicio («Términos») rigen el uso que usted haga de la plataforma, los productos y los servicios de Cocinando con el Chef Gaytan (los «Servicios»). Cocinando con el Chef Gaytan es operado por Papudoz LLC, DigiTec Agency LLC, Sergio Carretero Hilillo («Cocinando con el Chef Gaytan », «nosotros» o «nuestro»). Al acceder a nuestros Servicios o utilizarlos, usted acepta quedar vinculado por estos Términos.
Si no está de acuerdo con alguna parte de estos Términos, no podrá acceder ni utilizar nuestros Servicios.

Este Acuerdo establece sus derechos y obligaciones como Usuario de Cocinando con el Chef Gaytan. Al hacer clic en “Acepto”, usted indica que ha leído y comprendido este Acuerdo y que se compromete a cumplir sus términos.

Este acuerdo contiene cláusulas de arbitraje y renuncia a demandas colectivas que implican la renuncia a su derecho a una audiencia judicial, a un juicio con jurado y a participar en una demanda colectiva. El arbitraje es obligatorio y constituye el único recurso para cualquier controversia, salvo lo dispuesto en la Sección 18.

Queda estrictamente prohibido el uso de dichas marcas sin autorización expresa por escrito. Este Acuerdo no le otorga el derecho a usar, copiar, registrar como nombre de dominio, reproducir ni exhibir de ninguna otra forma ningún logotipo, eslogan, marca registrada, nombre comercial, material protegido por derechos de autor, patente, imagen comercial, secreto comercial ni información confidencial propiedad de Cocinando con el Chef Gaytan o cocinandoconelchefcarlosgaytan.com.
Sujeto a su estricto cumplimiento continuo de estos Términos, Cocinando con el Chef Gaytan le otorga una licencia revocable, limitada, no exclusiva, gratuita, no sublicenciable e intransferible para usar el Sitio web. Usted reconoce y acepta que no adquiere ningún derecho de propiedad sobre ningún material protegido por las leyes de propiedad intelectual.

E. Actividades comerciales ilegales. Se prohíbe promover actividades ilegales; promover la venta o el uso de drogas ilegales; o infringir los derechos de propiedad intelectual de otros.
SECCIÓN 3 – NUESTRA POLÍTICA DE PRIVACIDAD Y SU INFORMACIÓN PERSONAL
Respetamos su privacidad y la protección de su información personal. El envío de su información personal a través del Sitio Web se rige por nuestra Declaración de Privacidad, la cual se incorpora a este Acuerdo por referencia. Cocinando con el Chef Gaytan se reserva el derecho de modificar su Declaración de Privacidad a su entera discreción.
SECCIÓN 4 – INFORMACIÓN QUE USTED PROPORCIONA
Como usuario de Cocinando con el Chef Gaytan usted garantiza que la información que proporciona es veraz y precisa, y que no está suplantando la identidad de otra persona. Es responsable de mantener la confidencialidad de sus credenciales de cuenta, incluida su contraseña, y se compromete a no transferir su contraseña, nombre de usuario ni acceso a su cuenta a terceros.
Usted se compromete a notificar inmediatamente a Cocinando con el Chef Gaytan sobre cualquier uso no autorizado de las credenciales de su cuenta o cualquier otra violación de seguridad. Asimismo, acepta que Cocinando con el Chef Gaytan no será responsable, y usted eximirá de toda responsabilidad a Cocinando con el Chef Gaytan, por cualquier pérdida o daño que surja como consecuencia del incumplimiento de estas obligaciones.
SECCIÓN 5 – REALIZACIÓN Y ACEPTACIÓN DE PEDIDOS
Si solicita un servicio o producto, Cocinando con el Chef Gaytan debe recibir el pago antes de que se acepte su pedido. Es posible que le solicitemos información adicional si su pedido está incompleto o contiene errores, y podemos cancelarlo o limitarlo en cualquier momento después de que se haya realizado.
Una confirmación de pedido electrónica, o cualquier otra forma de confirmación, no implica la aceptación de su pedido por nuestra parte. Si desea modificar o cancelar un pedido pendiente, debe contactar inmediatamente a Hotmart. No podemos garantizar que podamos modificar su pedido según sus instrucciones.

SECCIÓN 7 – CONDICIONES DE SUSCRIPCIÓN Y PAGO AUTOMÁTICO
El usuario de Cocinando con el Chef Gaytan es responsable de pagar todas las cantidades adeudadas en relación con su suscripción o producto, de conformidad con estos Términos. El pago de la suscripción se debe realizar al crear la cuenta de usuario (o inmediatamente después de la finalización de cualquier período de prueba, si corresponde), y dicho pago es condición para el acceso.
Los usuarios pueden pagar con tarjeta de crédito o débito. Los datos de pago se recopilan mediante un mecanismo seguro de recopilación de datos financieros. Usted reconoce y acepta que Cocinando con el Chef Gaytan y Hotmart puede almacenar datos relacionados con la transacción, incluidos los últimos cuatro dígitos y la fecha de vencimiento de su tarjeta de pago, junto con detalles sobre los plazos de pago. Asimismo, reconoce y acepta que los pagos podrían o no, realizarse de forma recurrente (por ejemplo, mensual o anual, según su suscripción) a menos que se cancelen de acuerdo con estos Términos, y autoriza los cargos recurrentes automáticos a su método de pago.
En caso de que haya una suscripción periódica, si tiene una suscripción mensual y ha proporcionado una tarjeta de crédito o débito válida, o un método de pago alternativo, cada pago se procesará automáticamente en la fecha de pago designada y se facturará al método de pago que proporcionó al registrarse. Si desea cancelar su suscripción, debe hacerlo a través del panel de control de su cuenta al menos veinticuatro (24) horas antes de su próxima fecha de facturación o renovación anual.
Cocinando con el Chef Gaytan se reserva el derecho de cancelar la cuenta o el servicio de un usuario de inmediato por cualquier período de suscripción impagado, con o sin previo aviso. La cancelación del servicio no lo exime de ninguna obligación de pago pendiente.
Además de las tarifas, Cocinando con el Chef Gaytan puede cobrar el impuesto al valor agregado u otros impuestos aplicables.
SECCIÓN 8 – PRODUCTOS, SERVICIOS Y PRECIOS DISPONIBLES EN EL SITIO WEB
Los productos, servicios y precios generalmente se encuentran publicados en el sitio web, pero están sujetos a cambios. Cocinando con el Chef Gaytan se reserva el derecho, sin previo aviso, de discontinuar o modificar productos, servicios, especificaciones y precios sin incurrir en ninguna obligación hacia usted. Salvo que se indique expresamente lo contrario en estos Términos, cualquier cambio de precio en su suscripción o compras entrará en vigor tras el envío de una notificación por correo electrónico.
Los cambios de precio entrarán en vigor el primer día del mes siguiente a su notificación. Si solicita una reducción de servicios, esta y la correspondiente disminución de precio entrarán en vigor el primer día del mes siguiente a su solicitud. El uso continuado de los servicios de Cocinando con el Chef Gaytan tras recibir la notificación de cambio de precio implica la aceptación de la nueva tarifa.
Cocinando con el Chef Gaytan adopta las medidas necesarias para garantizar que los precios mostrados en el sitio web sean correctos y que la descripción de los artículos disponibles sea precisa. Si el precio correcto de un producto es superior al indicado, podremos, a nuestra discreción, ponernos en contacto con usted para obtener instrucciones o cancelar su pedido y notificarle dicha cancelación.

Cada empresa y persona es única y emplea estrategias, estructuras organizativas, productos y servicios diferentes. Por consiguiente, los resultados individuales variarán de un usuario a otro. LOS RESULTADOS INDIVIDUALES DE SU EMPRESA DEPENDERÁN DE DIVERSOS FACTORES PROPIOS DE SU NEGOCIO, INCLUIDOS, ENTRE OTROS, SU CONTENIDO, MODELO DE NEGOCIO Y OFERTA DE PRODUCTOS O SERVICIOS.
Cocinando con el Chef Gaytan no promete, garantiza ni asegura el éxito, los ingresos ni conocimiento en gastronomia. Usted reconoce y comprende que Cocinando con el Chef Gaytan. Los compradores de nuestros productos o servicios pueden tener acceso al curso de cocina. Sin embargo, debido a numerosos factores de mercado ajenos a nuestro control, no garantizamos que nuestro curso o servicios sean aplicables o eficaces en su negocio en particular.
No garantizamos ganancias, retorno de inversión ni que nuestros productos generen ingresos específicos, y es posible que no recupere su inversión. Cocinando con el Chef Gaytan no vende oportunidades de negocio, programas para hacerse rico rápidamente, sistemas garantizados, franquicias ni soluciones de negocio llave en mano. Las compras deben realizarse teniendo en cuenta que el uso de nuestros productos y servicios requiere tiempo y esfuerzo, y que su aplicabilidad puede variar según el contexto.
Además, no ofrecemos asesoramiento fiscal, contable, financiero ni legal. Debe consultar con profesionales cualificados, como su contable, abogado o asesor financiero, sobre estas cuestiones.
SECCIÓN 10 – TESTIMONIOS, RESEÑAS E IMÁGENES/VIDEOS
Cocinando con el Chef Gaytan agradece los comentarios de usuarios y clientes, y puede utilizar testimonios o reseñas de productos, en su totalidad o en parte, junto con el nombre, la ciudad y el estado de la persona que los envía. Dicho material puede utilizarse con fines de marketing, publicidad o promoción, tanto en medios impresos como digitales, a la entera discreción de Cocinando con el Chef Gaytan.
Los testimonios representan las experiencias de personas específicas y no necesariamente reflejan los resultados que usted o su empresa puedan obtener. Como se indica en la Sección 9, los resultados individuales variarán.
Al enviar testimonios, fotografías, videos o materiales relacionados, usted otorga a Cocinando con el Chef Gaytan una licencia gratuita, mundial, perpetua, irrevocable y no exclusiva para usar, reproducir, modificar y distribuir dicho contenido. Cocinando con el Chef Gaytan se reserva el derecho de editar los envíos para corregir errores gramaticales, mejorar la claridad y ajustar la extensión antes de su publicación. No estamos obligados a utilizar ningún testimonio ni reseña enviados.
SECCIÓN 11 – EXCLUSIÓN DE OTRAS GARANTÍAS
SALVO EN LOS CASO EN QUE LA LEY LO PROHÍBA O NO SEA APLICABLE:
El sitio web y todo su contenido se proporcionan «TAL CUAL» y «SEGÚN DISPONIBILIDAD», sin garantías de ningún tipo, ya sean expresas o implícitas, incluyendo, entre otras, las garantías de titularidad o las garantías implícitas de comerciabilidad o idoneidad para un propósito particular. No declaramos ni garantizamos, y rechazamos expresamente que:
(a) el uso del Sitio web o de cualquier software será seguro, oportuno, ininterrumpido o libre de errores, o funcionará en combinación con cualquier otro hardware, software, sistema o datos;
(b) el sitio web o los servicios cumplirán con sus requisitos o expectativas;
(c) cualquier dato almacenado será preciso o fiable;
(d) la calidad de cualquier producto, servicio, información u otro material comprado u obtenido por usted a través del Sitio web cumplirá con sus requisitos o expectativas;
(e) se corregirán los errores o defectos del sitio web; o
(f) el Sitio web o los servidores que hacen que el Sitio web esté disponible están libres de virus u otros componentes dañinos.
Se excluyen todas las condiciones, declaraciones y garantías, ya sean expresas, implícitas, legales o de otro tipo —incluidas, entre otras, las garantías implícitas de comerciabilidad, idoneidad para un propósito particular o no infracción de derechos de terceros— en la máxima medida permitida por la ley.
Usted se compromete a proteger, defender, indemnizar y eximir de responsabilidad a Cocinando con el Chef Gaytan, sus directivos, empleados, propietarios, empresas matrices y cesionarios frente a cualquier reclamación, demanda o acción legal de cualquier índole, sin limitación alguna, que surja de su conducta. Su obligación de indemnización incluye, entre otras cosas, cualquier reclamación de terceros contra Cocinando con el Chef Gaytan por responsabilidad por pagos, daños y perjuicios causados o cualquier otra responsabilidad relacionada con sus acciones u omisiones.
SECCIÓN 12 – LIMITACIONES DE RESPONSABILIDAD
SALVO EN LOS CASO EN QUE LA LEY LO PROHÍBA O NO SEA APLICABLE:
En ningún caso Cocinando con el Chef Gaytan ni ninguno de sus directivos, administradores, accionistas, empleados, contratistas independientes, proveedores de telecomunicaciones o agentes serán responsables de ningún daño indirecto, especial, incidental, ejemplar, consecuencial, punitivo o de otro tipo, ni de honorarios, costos o reclamaciones que surjan de o estén relacionados con este Acuerdo, la Política de Privacidad, los servicios o productos, o el uso o intento de uso que usted (o un tercero) haga del Sitio web, servicio o producto, independientemente de si Cocinando con el Chef Gaytan tenía conocimiento de la posibilidad de tales daños.
Esto incluye, entre otros: la pérdida de uso, la pérdida de beneficios, la pérdida de datos, la pérdida de reputación, el coste de adquisición de productos o servicios sustitutos, o cualquier otro daño indirecto, especial, incidental, punitivo, consecuencial o de otra índole. Esto se aplica independientemente de la forma en que se alegue que se causaron los daños y bajo cualquier teoría de responsabilidad, ya sea por incumplimiento de contrato, responsabilidad extracontractual (incluidas la negligencia y la responsabilidad objetiva), garantía o cualquier otra causa.
En ningún caso la responsabilidad de Cocinando con el Chef Gaytan hacia usted o su empresa excederá el mayor de los siguientes importes:
(a) tres (3) veces los pagos que usted realizó a Cocinando con el Chef Gaytan en el mes anterior a la fecha en que ocurrieron los hechos que dieron origen a la reclamación, o
(b) dos mil dólares ($2,000).
SECCIÓN 13 – RESOLUCIÓN DE DISPUTAS MEDIANTE ARBITRAJE VINCULANTE OBLIGATORIO Y RENUNCIA A DEMANDAS COLECTIVAS
LEA ATENTAMENTE ESTA SECCIÓN PARA COMPRENDER SUS DERECHOS.
Salvo en los casos prohibidos por ley, usted y su empresa aceptan que cualquier reclamación futura se resolverá mediante arbitraje confidencial, definitivo y vinculante. Usted reconoce y acepta que renuncia al derecho a un juicio con jurado. Los derechos que tendría ante un tribunal, como el de descubrimiento de pruebas o apelación, podrían estar más limitados o no existir en el arbitraje.
Asimismo, usted acepta que tanto usted como su empresa solo podrán presentar reclamaciones a título individual y no como demandante (principal o de otro tipo) ni como miembro de una demanda colectiva o procedimiento representativo. El árbitro no podrá acumular reclamaciones ni presidir ningún procedimiento representativo o colectivo.
Proceso de arbitraje:
Si tiene alguna queja, disputa o controversia, primero debe comunicarse con nosotros a CORREO para intentar resolver el asunto de manera informal. Cualquier reclamación o controversia que no pueda resolverse en un plazo de ciento veinte (120) días se resolverá mediante arbitraje vinculante y confidencial administrado por la Asociación Americana de Arbitraje (AAA) , y la sentencia será ejecutable ante cualquier tribunal competente.
El árbitro tendrá la facultad exclusiva para resolver cualquier controversia relativa a la interpretación, aplicabilidad, exigibilidad o formación de estos Términos, la Política de Privacidad, esta cláusula de arbitraje o cualquier otro término incorporado. Asimismo, el árbitro tendrá la facultad exclusiva para determinar si este acuerdo de arbitraje puede ejecutarse o ser invocado por una parte que no lo haya firmado.
Costos: El pago de todos los gastos de presentación, administración y honorarios del árbitro se regirá por las Reglas de la AAA. Cada parte será responsable de sus propios honorarios de abogados, honorarios de peritos y demás gastos.
